Introduction
Level Up Cincinnati, Inc. (“Level Up Cincinnati” “Level Up” “we” “us” or “our”) is a non-profit centered on supporting first-generation college students by offering coaching, support, and personal development. Additionally, we operate a related Level Up Cincinnati website at https://www.levelupcincinnati.org/ (the “Website”). Our non-profit services, website, any applications, or other services or content we may offer are collectively the “Services”. We are committed to respecting the privacy of information and data of the users of our Services.
This policy describes our policies and practices with respect to the collection and use of information that’s about you (your “Personal Information”) when you give it to us, visit our Website, donate to us, or use any Services. This information can be your name, email address, your contact information, and anything else that tells someone something about you. If you do not agree to the terms set forth herein, please do not use our Services. We reserve the right to update this Privacy Policy at any time, and the revision date above provides you with notice that the Privacy Policy has been updated. This Privacy Policy applies regardless of whether you use our Services via a computer, mobile device, tablet, or other medium (collectively, your “Equipment”).
Personal Information We Collect and How We Collect It
We collect several types of Personal Information from and about users of our Services, including:
· Identity Information. Examples include your first name and last name, birthday, mailing address, email address, phone number, photograph, or similar identifiers.
· Employment Information. Examples include your current job history or job title, your academic background, academic transcripts, and pre-employment screening and background check information (which may include criminal records information).
· Demographic Information. Examples include your age, marital and family status, number of children, income level, languages spoken, household demographic data, data from social media platforms, education and professional information, hobbies and interests and propensity scores from third parties (likelihood of donation, experiencing a life event, etc.).
· Communication Information. Examples include the communications you send us, your feedback that you communicate to us, and similar communication between you and us via email, social media, or any other medium.
· Technical Information. Examples include your Equipment’s hardware information, operating system, platform information, browser type, language information, browser plugin types, IP address, browsing activities and patterns, and similar technical information.
· Usage Information. Examples include information about how you use our Services.
· Financial Information. Examples include details on payment cards or other forms of payment.
· Transaction Information. Examples include details about donations and other payments you made to us.
· Profile Information. Examples include your interests, your coach-student relationship, your college experience, and similar information about your interests, preferences, feedback and responses with Level Up Cincinnati.
· Sensitive Personal Information, such as your racial or ethnic origin, if you opt in to share such information. For more information, see the section Sensitive Personal Information below.
We collect this information:
· Directly from you when you provide it to us.
· Automatically as you navigate through the site. Information collected automatically may include usage details, IP addresses, and information collected through cookies, web beacons, and other tracking technologies.
· From third parties including, for example, our affiliated companies, business partners, subcontractors, and service providers. We may also receive information from publicly available sources such as from social networking sites.
How We Use Your Information
Your Personal Information is used by us for the purpose it was collected, such as to provide you with our Services, communicate with you, or conduct other business operations, such as using information to improve and personalize your experience with us. Examples of how we may use the information we collect include:
· Manage our relationship with you which may include notifying you about changes to our Services, Terms of Use, and/or Privacy Policy, providing you notices, asking you to provide feedback or complete a survey, or addressing any concerns you may have about our Services.
· Send you newsletters and updates on our growth and impact as a non-profit;
· Respond to questions or comments from you;
· Provide support to our students, coaches, and donors as applicable;
· Plan and manage our contractual relationships with our vendors;
· Detect, prevent, and address technical issues;
· Complete internal analysis of information enabling us to monitor the usage of our Services;
· Improve our Services;
· Target our Services and efforts to the highest need;
· Determine student eligibility for our Services and prospective coach eligibility for volunteering as a Level Up coach;
· Facilitate strong and effective coach-student relationships and gauge the progress and wellbeing of our students;
· Track the impact of our charitable efforts;
· Address legal issues, including (i) complying with our obligations to retain certain business records; (ii) establishing, exercising, or defending legal claims; (iii) complying with laws, regulations, court orders, or other legal processes; (iv) detecting and preventing fraud or intellectual property infringement claims, violations of our contracts or agreements, violations of law, or other misuses of our Services; and (v) protecting our rights or property, or yours or others’ health, safety, welfare, rights, or property; and
· Allow you to exercise your data privacy rights.
In addition, we may process your personal data for the following reasons:
· To carry out our obligations and enforce our rights.
· In any other way we may describe when you provide the information.
· For any other purpose with your express consent.
We may use information that is not Personal Information for any purpose. For example, we may use aggregated data such as statistical data or aggregate demographic data for any purpose (“Aggregated Data”). Aggregated Data could be derived from your Personal Information, but Aggregated Data is not considered Personal Information, as this data will not directly or indirectly reveal your identity. For example, we may aggregate your usage data to calculate the percentage of users accessing our Services. However, if we combine or connect Aggregated Data with your Personal Information so that it can directly or indirectly identify you, we treat the combined data as Personal Information which will be used in accordance with this Privacy Policy.
Disclosure of Your Information
We may disclose Personal Information that we collect or you provide as described in this privacy policy:
· To affiliated companies, business partners, subcontractors, service providers, and other third parties we use to support our organization.
· To a successor in the event of a merger, restructuring, reorganization, dissolution, or other transfer of some or all of Level Up Cincinnati’s assets, whether as a going concern or as part of bankruptcy, liquidation, or similar proceeding, in which Personal Information held by Level Up about the users of our Services is among the assets transferred.
· To third parties to market their products or services to you if you have not opted out of these disclosures.
· To fulfill the purpose for which you provide it.
· To perform our purposes for processing it (see How We Use Your Information).
· For any other purpose disclosed by us when you provide the information.
· With your consent.
Cookies and Automatic Data Collection Technologies
Our Services may use automatic data collection technologies to distinguish you from other users. It also allows us to improve our Services by enabling us to:
· Estimate our audience size and usage patterns.
· Store your preferences, so we may customize our Services according to your individual interests.

Our website pages and emails may contain small transparent embedded images or objects known as web beacons (also referred to as clear gifs, pixel tags, and single-pixel gifs) that permit us, for example, to count website page visitors or email readers, or to compile other similar statistics such as recording website content popularity or verifying system and server integrity. Sensitive Personal Information
Sensitive personal information means Personal Information that reveals (A) a consumer’s social security number, driver’s license, state identification card, or passport number; (B) a consumer’s account log-in, financial account, debit card, or credit card number in combination with any required security or access code, password, or credentials allowing access to an account; (C) a consumer’s precise geolocation; (D) a consumer’s racial or ethnic origin, religious or philosophical beliefs, or union membership; (E) the contents of a consumer’s mail, email, and text messages unless the business is the intended recipient of the communication (F) consumer’s genetic data; (G) biometric information for the purpose of uniquely identifying a consumer; (H) personal information collected and analyzed concerning a consumer’s health; (I) personal information collected and analyzed concerning a consumer’s sex life or sexual orientation.
In the last 12 months, we may have collected and used the following sensitive personal information.
o Your bank account and financial information, your racial or ethnic origin.
This information is used to perform services of processing your payment for donations if donations are made directly to us and not through our third-party payment portal (in the case of bank account and financial information) and to facilitate your use of the Services if you choose to provide other details about yourself.
Third Party Links
Our Services may include links to other websites we do not control and whose privacy policies may differ from this Privacy Policy. If you submit Personal Information to any of those sites, such information is subject to third party privacy statements, including without limitation when you provide any donations through our third-party payment portal. We strongly encourage you to carefully read the privacy statement of any website you visit.
Security
We use industry-standard encryption technologies when transferring and receiving consumer data exchanged with our Services. However, the Internet environment is not 100% secure, and we cannot guarantee that information we collect will never be accessed in an unauthorized way. It is your responsibility to protect your login information used in connection with the Services, and you should not share your password.
Your Rights and Choices
Your rights may vary depending on where you are located.
· Accessing, Updating, and Deleting Your Information. You can contact us as set forth in the Contact Information section below to request access to, correction of, or deletion of Personal Information that you have provided to us. We may also ask you to verify your identity before we respond to your request. Depending on your request, we may not accommodate your request to change information if we believe the change would violate any law or legal requirement or negatively affect the information’s accuracy.
· Cookies and Automatic Data Collection Technologies. You can set your browser to refuse all or some browser cookies, or to alert you when websites set or access cookies. However, if you disable or refuse cookies, please note that some parts of these websites may become inaccessible or not function properly.
We do not control third parties’ collection or use of your information to serve interest-based advertising. However, these third parties may provide you with ways to choose not to have your information collected or used in this way. Children Under the Age of 13
Our Services are not intended for children under 13 years of age. We will not knowingly solicit or collect Personal Information from children under 13, or the relevant minimum age under applicable local legal requirements, except as permitted under applicable law. If we learn that we have received information directly from a child under 13 without his or her parent’s or legal guardian’s consent, we will make commercially reasonable efforts to delete such information.
Changes to Our Privacy Policy
Changes to this Privacy Policy will be posted on this site, along with information on any material changes. Level Up Cincinnati reserves the right to update or modify this Privacy Policy at any time and without prior notice. Your continued use of our Services after the posting of the amended Privacy Notice on the Website constitutes your affirmative (1) Acknowledgement of the Privacy Policy as amended; and (2) agreement to be bound by the Privacy Policy as amended.
